التعريفات

في هذي الشروط والأحكام:

إحنا / موقعنا / شركتنا يقصد فيهم saifalnajmi.com (المسجل في الكويت).
إنت / العميل يقصد فيك الشخص اللي يشتري أي سلعة من موقعنا.
العقد يعني الاتفاق بينا وبينك على بيع السلع.
السلع يقصد فيها أي منتج أو خدمة تطلبها من موقعنا.
المستهلك يعني أي شخص طبيعي يشتري لاحتياجه الشخصي مو التجاري أو المهني.

المبيعات التجارية

إذا طلبت السلع لغرض تجاري أو باسم مؤسسة:

هذي الشروط ما تنطبق عليك.
يتم تطبيق شروط وأحكام المبيعات التجارية الخاصة فينا على طلبك والعقد الناتج عنه.

شروط العقد

هذي الشروط والأحكام تنطبق إذا كنت تطلب السلع كمستهلك.
نقدر نحدّث الشروط بأي وقت، وأي تعديل يطبق فقط على الطلبات الجديدة بعد التحديث.
في حال وجود اختلاف بين هذي الشروط والمذكور في الموقع، الكلمة الأخيرة لهذي الشروط.

متى يتم إنشاء العقد

ما يعتبر في عقد بينا وبينك إلا لما نأكد قبول طلبك ونسلمك السلع.
لنا الحق نرفض أو نلغي الطلب إذا ما قدرنا نوفر السلع لأي سبب.

وصف وأسعار السلع

نحاول دايمًا نخلي الأسعار والوصف دقيقين بقدر الإمكان.
السعر اللي تشوفه وقت الدفع هو السعر اللي ينحسب عليك.
في حال صار خطأ بالسعر، راح نتواصل معاك قبل ما نأكد الطلب، وتقدر تختار تكمل أو تلغي.

التوصيل

التوصيل يتم على العنوان اللي تحطه وقت الطلب.
مسؤوليتك إن العنوان يكون صحيح وواضح.

السلع التالفة

السلع التالفة هي اللي ما تطابق العقد أو فيها خلل واضح.
ما تشمل العيوب الناتجة عن سوء استخدام، إهمال، كسر متعمد أو تعديل غير مصرح فيه.
لازم تبلغنا بأسرع وقت إذا استلمت سلعة فيها خلل.

سياسة استرجاع السلع

عند استرجاع أي سلعة، الرجاء الالتزام بالنقاط التالية:

غلّف السلعة بشكل آمن وواضح عليه عنواننا.
أي ضرر يصير بسبب تغليف غير مناسب يكون على مسؤوليتك.
إذا كانت السلعة فيها خلل أو مو شغالة، راح نرسل سواقنا يستلمها منك.
أما إذا كانت السلعة سليمة وتشتغل تمام لكن العميل حاب يرجعها بدون سبب فني، لازم يزور المعرض بنفسه لإتمام الاسترجاع.

الظروف الخارجة عن الإرادة

إحنا ما نتحمل أي تأخير أو فشل في تنفيذ التزاماتنا إذا كان بسبب ظروف خارجة عن إرادتنا مثل الكوارث أو مشاكل النقل أو الأعطال العامة.

تحديد المسؤولية

ما نتحمل أي خسارة أو ضرر إلا في الحالات التالية:

إذا كان نتيجة إخلال بواجب قانوني علينا.
أو كان الضرر ممكن توقعه وقت قبول الطلب.

أقصى مسؤولية علينا تكون ضعف قيمة السلعة اللي تم طلبها.
هالشي ما يأثر على حقوقك القانونية ولا يحد من مسؤوليتنا في حالات الإصابة أو الوفاة أو الغش الناتج عن الإهمال.

If the goods are damaged or not functioning, our driver will arrange pickup from your location.
If the goods are in working condition and the customer simply wishes to return them, the return must be made in person at our store.

Unavoidable Circumstances

We are not liable for delays or failure to fulfill obligations caused by events beyond our control.

Liability Limitation

We are not liable for any loss or damage unless:

It results from a breach of our legal duties.
It was reasonably foreseeable when we accepted your order.

Our maximum liability to you is twice the value of the goods ordered. This does not affect your statutory rights or limit our liability for personal injury, death, or fraudulent misrepresentation caused by negligence.
